Lodi Soft Tissue Injury Lawyer

Injured in Jersey? Peter's Got Your Back!

A neck that will not turn, a shoulder that aches at night, or a back that locks up at work can take over your life, and our Lodi soft tissue injury lawyer at The Law Offices of Peter N. Davis & Associates, LLC knows these injuries are real even when an X-ray looks clean.

We help people hurt in crashes, falls, and other accidents caused by someone else’s carelessness.

Insurance companies often treat whiplash, sprains, and strains as “minor” injuries that do not deserve fair pay. Meanwhile, you may be missing work, paying for therapy, and wondering if the pain will ever fully go away.

Waiting can make things worse, because gaps in treatment and fading evidence give insurers more room to deny your claim. As a Lodi personal injury lawyer team that has recovered over $1 billion in over 37 years, we build soft tissue claims with the medical proof New Jersey law demands.

When a sprain or strain becomes a legal claim

A soft tissue claim follows the same basic rules as other New Jersey injury cases. Our team works to prove each of these elements:

  • Duty of care: The person or business responsible had a legal duty to act safely. This includes drivers on Route 46, store owners on Main Street, and companies that make consumer products.
  • Breach of duty: They failed to meet that duty through careless driving, a wet floor left unmarked, or a similar mistake. We gather proof of exactly what went wrong.
  • Causation: The accident caused your injury or made an old one worse. Medical records that tie your symptoms to the incident are key here.
  • Damages: You suffered real losses, such as medical bills, missed paychecks, and pain. Without damages, there is nothing to recover.

Car crash claims carry an extra hurdle in New Jersey. Many drivers have the Limitation on Lawsuit option, often called the verbal threshold, which limits pain and suffering lawsuits to injuries listed in the New Jersey auto insurance buyer’s guide, including permanent injury.

Under N.J.S.A. 39:6A-8(a), a treating or referred physician must certify the permanent injury within 60 days after the defendant answers the complaint. That certification must rest on objective clinical evidence, and testing cannot depend entirely on what the patient reports.

The good news is that in DiProspero v. Penn, the New Jersey Supreme Court held that you do not also have to prove a serious impact on your life. You need to prove a permanent injury with objective medical evidence, and that is where we focus our work.

Hypothetical scenario: A driver stopped at a light on Main Street in Lodi is rear-ended and feels only stiffness that night. Weeks later, an MRI shows a disc problem and nerve testing confirms ongoing damage, which gives the physician objective evidence to support a permanent injury certification.

Losses you can claim for a soft tissue injury

The losses you can claim depend on how you were hurt and how the injury affects your daily life. These are the main types of damages:

  • Economic damages: These cover costs with a price tag, such as doctor visits, MRIs, physical therapy, injections, and lost wages. They can also include future treatment and reduced earning ability.
  • Non-economic damages: These cover pain, sleepless nights, and lost enjoyment of hobbies or family time. In car cases, the verbal threshold decides whether these are available.
  • Punitive damages: Courts award these only in rare cases involving especially reckless or malicious conduct. They are not part of most soft tissue claims.

Why soft tissue settlements vary so much

No honest lawyer can put a number on your case before treatment ends and your doctors issue final reports. The table below shows the factors that tend to raise or lower the value of a soft tissue claim in New Jersey.

Factor Tends to increase value Tends to lower value
Objective medical proof MRI, EMG, or other test results that confirm the injury Records based only on reported pain
Permanency A doctor certifies the injury will not heal to function normally Full recovery within a short time
Treatment history Prompt care and consistent follow-up Long gaps between visits
Impact on work Documented missed time or job restrictions No lost time or restrictions
Fault The other party was clearly at fault You share a large part of the blame
Insurance coverage Adequate liability limits Low policy limits with no other coverage

Every case is different, but some of our past results involve the types of injuries that often include soft tissue damage. Here are a few of them:

  • $400,000: Recovered for a client with a neck injury. Neck cases often turn on imaging and specialist opinions.
  • $325,000: Recovered for a client with a knee injury. Knee claims can involve ligament, tendon, or cartilage damage.
  • $255,000: Recovered for a client with a neck injury. This result shows that these claims can carry real value.

Disclaimer: Past results do not guarantee a similar outcome in your case. Each claim depends on its own facts, injuries, and insurance coverage.

Whiplash, sprains, and other injuries we handle

We handle every kind of injury claim, but these soft tissue cases come through our door most often:

  • Back sprains and muscle strains
  • Bruises and deep contusions
  • Herniated or bulging discs that occur with soft tissue damage
  • Rotator cuff tears and other shoulder injuries
  • Sprained ankles, knees, and wrists
  • Torn ligaments, such as ACL and MCL tears
  • Torn tendons and muscles
  • Whiplash and other neck injuries

When a disc or nerve injury is the main problem, our back and spinal injury claims team handles that side of the case.

Why our Lodi soft tissue injury law firm knows insurer tactics

Peter N. Davis spent the early part of his career doing insurance defense work, so he knows how adjusters size up soft tissue claims. Here is how we put that experience to work for you:

  • Proving the injury is real: We work with your doctors to get the imaging and testing that objective proof requires. This is often the difference between a denied claim and a fair one.
  • Meeting the verbal threshold: We track the deadline for the physician certification in car cases. A missed or weak certification can end a case early.
  • Recovering lost wages: We document every missed shift and any job restrictions your doctor sets. Pay stubs and employer letters help prove these losses.
  • Handling medical bills: We sort out what PIP, health insurance, or other coverage should pay. That way, bills do not pile up while your case moves forward.
  • Countering “minor injury” arguments: We use your treatment records and specialist opinions to answer claims that you should have healed by now. We also explain how pain affects your daily life.
  • Documenting setbacks: Flare-ups and slow progress are common with soft tissue injuries. We make sure those setbacks show up in the record.
  • Valuing future care: Some injuries need ongoing therapy, injections, or surgery down the road. We factor those costs into any demand.

Many of these claims start with a crash, and our Lodi car accident lawyer page covers that side of the claim in more detail. If your injury happened at work, a workers’ compensation claim may also apply.

Myths insurers want you to believe about soft tissue injuries

Insurers count on people believing a few common myths about soft tissue claims. Here is the truth behind them:

Myth Fact
“No broken bones means no real injury.” Torn ligaments, tendons, and muscles can cause months of pain and lasting limits, even when X-rays are normal.
“The verbal threshold means I cannot sue for a car crash injury.” You can still sue for pain and suffering if you prove a permanent injury with objective medical evidence.
“I have to show the injury ruined my life.” New Jersey’s highest court removed that extra requirement in 2005, so the focus is on proving permanency.
“If I felt fine at the scene, I was not hurt.” Soft tissue symptoms often show up hours or days later, once adrenaline wears off.
“PIP will cover everything, so I do not need a lawyer.” PIP pays medical bills first, but it does not pay for pain and suffering and it has limits.

Steps to protect your health and your claim

If you are reading this at home and still hurting, these steps can protect both your health and your claim:

  1. Get in touch with our Lodi soft tissue injury lawyer: We can tell you early whether your case may face the verbal threshold and what proof you will need. Waiting until the insurer denies your claim leaves less time to fix gaps.
  2. See a doctor and follow up: Visit your primary doctor, an orthopedist, or a physiatrist who can order the right tests. Skipping follow-up visits is one of the most common reasons insurers cut offers.
  3. Ask about imaging and nerve tests: MRIs and EMG studies can show damage that X-rays miss. Do not assume your doctor will order them without hearing all your symptoms.
  4. Describe your pain honestly: Tell your providers about every symptom, including headaches, numbness, and trouble sleeping. Downplaying pain to seem tough can hurt your claim later.
  5. Stick with your therapy plan: Go to every physical therapy session and do your home exercises. Insurers often argue that missed sessions prove you were not really hurt.
  6. Do not give a recorded statement: The other side’s adjuster may call quickly and sound friendly. Politely decline and let us handle that conversation.
  7. Do not accept a quick offer: Early offers often come before anyone knows if the injury is permanent. Once you sign a release, you usually cannot reopen the claim.
  8. Keep a recovery journal: Write down pain levels, missed events, and tasks you can no longer do. These notes help show the real impact of your injury.

Why insurers push back on soft tissue claims

In our experience, soft tissue claims draw more pushback from insurers than almost any other injury type. Handling these tactics alone is hard, but we deal with them every day:

  • Calling it “just a sprain”: Adjusters label your injury as minor so they can offer less. They may ignore MRI findings or specialist reports.
  • Blaming a pre-existing condition: Insurers comb through old records looking for any prior neck or back complaint. They then argue the accident did not cause your pain.
  • Pointing to treatment gaps: A few missed weeks of therapy can become the insurer’s main argument. They claim you must have recovered or found the injury unimportant.
  • Questioning low-speed crashes: Insurers sometimes argue that little vehicle damage means little injury. Your medical evidence matters more than the dent in your bumper.
  • Using surveillance: Investigators may record you carrying groceries or doing yard work. They use short clips to suggest you are not really hurt.
  • Challenging the physician certification: In car cases, defense lawyers often attack whether the certification rests on objective evidence. We make sure your doctors support their findings.

Hypothetical scenario: A shopper slips on a spilled liquid in a Lodi supermarket and catches herself on a shelf, tearing her rotator cuff. The store’s insurer calls it a shoulder strain until an MRI shows the tear and her surgeon explains why she needs repair surgery.

Additional reading: three tactics insurance companies use to undermine your injury claim

What if the insurance company says you have already healed?

Feeling better than you did in week one is not the same as being fully healed. Here is what we look for when an insurer says your injury has resolved:

  • Ongoing pain after therapy ends: Many people still have pain or stiffness after formal treatment stops. Your doctor’s notes can show symptoms that never went away.
  • Reduced range of motion: Measured limits in how far you can turn your neck or lift your arm are objective findings. These measurements can support a claim of lasting harm.
  • Scar tissue and weakness: Torn muscles and ligaments may heal with scar tissue that is weaker than before. This can raise the risk of reinjury.
  • Flare-ups with normal activity: Pain that returns with work, lifting, or sitting for long periods is a sign the injury is not fully resolved. We make sure these flare-ups are documented.

How long you have to file in New Jersey

New Jersey generally gives you two years from the date of injury to file a personal injury lawsuit under N.J.S.A. 2A:14-2. If you miss that deadline, the court will likely dismiss your case no matter how strong it is.

Soft tissue injuries often take months to show whether they are permanent, but healing time does not pause the deadline. Lawsuits in Bergen County are filed with the Superior Court at the Bergen County Justice Center in Hackensack, and we keep track of every date so you do not run out of time.

Proving an injury that doesn't show up on an X-ray

Strong evidence is what separates a paid soft tissue claim from a denied one. Start saving these items as soon as you can:

  • Imaging results: MRI reports, ultrasound results, and any X-rays taken after the accident.
  • Nerve testing: EMG or nerve conduction study results if you have numbness or tingling.
  • Treatment records: Notes from your doctors, orthopedists, chiropractors, and physical therapists.
  • Accident report: A copy of the report from the Lodi Police Department or the agency that responded.
  • Photos and video: Pictures of the scene, vehicle damage, bruising, and any hazard that caused a fall.
  • Work records: Pay stubs, missed time records, and any work restrictions from your doctor.
  • Prescriptions and receipts: Pharmacy records, braces, heating pads, and travel costs to appointments.

Gathering all of this while you are in pain can feel like a second job. Let us take that burden off your shoulders so you can focus on getting better while we do the hard work.

What it costs to hire us

We handle soft tissue injury cases on a contingency fee basis, so you pay no attorney fee unless we recover money for you. Our fee comes out of the settlement or verdict, not out of your pocket.

New Jersey also limits what injury lawyers can charge. Under Court Rule 1:21-7, the fee is capped at 33 1/3% on the first $750,000 recovered, with lower limits on larger amounts.

Paying for physical therapy and treatment while you wait

This is one of the first questions our clients ask. The answer depends on how you were hurt:

  • Personal injury protection (PIP): In a car crash, your own PIP coverage pays your medical bills first, no matter who caused the accident. Some drivers choose their health insurance as the primary payer, which changes the order.
  • Health insurance: For falls and other non-car accidents, your health insurance usually pays as you go. Your plan may later ask to be paid back from your settlement, which is called a lien.
  • Workers’ compensation: If you were hurt on the job, workers’ compensation generally covers your medical treatment. A separate claim against a third party may also be possible.
  • Payment from the settlement: Some unpaid balances and liens are settled when your case resolves. We work to reduce those amounts so more of the money goes to you.

How we build and settle your soft tissue claim

Here is how we move your soft tissue claim from the first call to the final check:

  1. Free case review: We listen to your story, review your injuries, and explain your options. There is no cost and no obligation.
  2. Investigation: We collect police reports, photos, witness statements, and insurance details. We also check policy limits early.
  3. Medical support: We help you get the right specialists and objective testing. This builds the medical proof your claim needs.
  4. Coverage and bills: We set up PIP, health insurance, or other coverage so treatment can continue. We also deal with lien holders for you.
  5. Damages review: Once treatment ends or your doctor reaches a final opinion, we total your losses. This includes future care and lost earning ability.
  6. Demand and negotiation: We send a detailed demand to the insurer and push back on low offers. Most cases settle at this stage.
  7. Lawsuit if needed: If the insurer will not pay fairly, we file suit before the deadline. In car cases, we serve the physician certification on time.
  8. Trial or settlement: We prepare every case as if it may go to trial. That readiness is often what moves insurers to pay.

Soft tissue injuries explained

Soft tissue injuries affect the muscles, tendons, and ligaments that hold your body together and let it move. Lodi’s busy roads, including Route 46 and Route 17, along with local stores and job sites, see these injuries every day.

Our New Jersey soft tissue injury lawyer page covers these claims statewide. The sections below focus on what Lodi residents tend to ask us most.

Common soft tissue injuries in accident cases

Knowing the name of your injury can help you talk with your doctor and with us. These are the injuries we see most often:

  • Contusions: Deep bruises happen when a blow crushes muscle fibers and blood vessels. Severe ones can cause swelling and stiffness that last for weeks.
  • Rotator cuff tears: The rotator cuff is a group of muscles and tendons that keep the shoulder stable. A tear can make it hard to lift your arm or sleep on that side.
  • Sprains: A sprain is a stretched or torn ligament, often in the ankle, knee, or wrist. Doctors grade them from mild stretching to a complete tear.
  • Strains: A strain is a stretched or torn muscle or tendon, often in the back or neck. Lifting and sudden twisting make strains worse.
  • Tendon tears: Tendons connect muscle to bone, and a full tear can require surgery. The Achilles tendon and biceps tendon are common examples.
  • Whiplash: Whiplash happens when the head snaps forward and back, straining the neck. Rear-end crashes are the classic cause.

Additional reading: how long whiplash lasts after a car accident

When soft tissue injuries require surgery

Most soft tissue injuries heal with rest and therapy, but some need surgery. These situations often point toward a surgical repair:

  • Complete tears: A fully torn ligament or tendon usually cannot reattach on its own. Rotator cuff and ACL tears are common examples.
  • Failed conservative care: When months of therapy and injections do not help, doctors may recommend surgery. This decision often signals a more serious, lasting injury.
  • Instability in a joint: A knee or shoulder that keeps giving way may need repair to prevent more damage. Surgeons may also tighten loose ligaments.
  • Longer recovery times: Surgery often adds months of rehab and time off work. These added losses should be part of your claim.

How accidents cause soft tissue damage

Any sudden force can damage soft tissue. These are the causes we see most in Lodi and the surrounding area:

  • Car accidents: Rear-end and side-impact crashes often cause whiplash and back strains. Even low-speed impacts can injure the neck.
  • Dog attacks: Being knocked down by a dog or pulling away from a bite can tear muscles. Bites also cause deep tissue damage.
  • Pedestrian and bicycle accidents: Being struck by a car can cause sprains, tears, and deep bruising. These injuries often come with other harm.
  • Slip and falls: Wet floors, broken sidewalks, and icy lots lead to sprained ankles and torn shoulders. Reaching out to break a fall is a common cause of wrist and shoulder injuries.
  • Truck accidents: The force of a large truck can cause severe soft tissue injuries along with other trauma. These cases often involve more than one insurer.
  • Workplace accidents: Lifting, repetitive motion, and falls on the job cause many strains. These claims usually go through workers’ compensation.

How long soft tissue injuries take to heal

Recovery depends on the type of injury, how severe it is, and how soon treatment starts. The table below gives general ranges, but your doctor’s opinion about your own case is what counts.

Injury type Typical recovery time Common treatment
Mild sprain or strain A few days to a few weeks Rest, ice, over-the-counter pain relief
Moderate sprain or strain Several weeks to a few months Bracing, physical therapy
Whiplash A few weeks to several months, sometimes longer Physical therapy, medication, injections
Complete ligament or tendon tear Several months or more Surgery plus rehab
Rotator cuff tear with surgery Often six months or more Surgical repair plus long-term therapy

In our experience, the clients who struggle most are those whose pain lingers past the expected window. Delayed healing, reinjury from returning to work too soon, and lasting limits after treatment ends are all common, and each one can change the value of a claim.

Symptoms and diagnosis of soft tissue injuries

Common signs include pain, swelling, bruising, stiffness, and muscle spasms near the injured area. Neck injuries can also cause headaches, dizziness, and numbness or tingling in the arms.

Doctors start with a physical exam that checks strength, range of motion, and reflexes. They may then order an MRI or ultrasound to see soft tissue, and an EMG to check nerve function, often through providers such as Hackensack University Medical Center.

Early imaging matters for more than your health. Tests done close to the accident date make it harder for an insurer to blame your injury on something that happened later.

Complications and long-term effects

Some soft tissue injuries leave lasting effects even after treatment. These are the long-term problems we see most:

  • Chronic pain: Pain can continue for months or years after the accident. It can affect sleep, mood, and the ability to work.
  • Joint instability: Damaged ligaments may leave a joint loose and prone to giving way. This raises the risk of future injuries.
  • Early arthritis: Injured joints may wear down faster over time. This can lead to more treatment later in life.
  • Nerve problems: Swelling or disc injuries that occur with soft tissue damage can press on nerves. This can cause numbness or weakness in the arms or legs.

Frequently Asked Questions

Yes, you can still recover money as long as your share of fault is not greater than the other party’s share under N.J.S.A. 2A:15-5.1. Your award is reduced by your percentage of fault, and being found more than 50% at fault bars recovery from that party.

Chiropractic care does not hurt your claim on its own, and many find it helpful, but issues arise when it is the only treatment and no doctor orders imaging. We suggest also seeing a medical doctor so your records include objective testing and a physician who can support permanency.

An independent medical exam is a visit with a doctor the insurance company chooses and pays, and despite the name, that doctor often reports that your injury is minor or healed. We prepare you before the exam, and you should answer honestly, avoid exaggerating, and tell us what happened.

It is wise to post as little as possible until your case ends, because insurers look for photos of you smiling, traveling, or lifting things to argue you are not hurt. Set your accounts to private, avoid discussing the accident online, and never delete posts without first asking us.

Most cases cannot settle until you finish treatment or your doctor reaches a final opinion on permanency, and many claims settle within a reasonably short time after that point. If a lawsuit is needed, the court schedule can add a year or more, but we keep you updated throughout.
