Injured in Jersey? Peter's Got Your Back!
A head injury can change how you think, feel and live in a single moment. If someone else's carelessness hurt you or a loved one, The Law Offices of Peter N. Davis & Associates, LLC is the Lodi brain injury lawyer team ready to stand with you.
24/7 Service Available
Brain injuries are often hidden. You may look fine on the outside while headaches, memory gaps and mood changes take over your days.
Meanwhile, the insurance company is already building its case against you. Adjusters may push a fast, low offer before your doctors know how serious the injury really is.
Waiting has a cost, too. Records get harder to tie to the accident, witnesses forget and the 2-year filing deadline keeps running.
Peter N. Davis is a Lodi personal injury lawyer who once worked in insurance defense, so he knows how insurers value head injury claims. As your Lodi traumatic brain injury lawyer, The Law Offices of Peter N. Davis & Associates, LLC brings over 37 years of experience and over $1 billion recovered for injured people.

Proving another party caused your brain injury
To win a brain injury claim in New Jersey, we must prove four key facts. Our team gathers the proof for each one:
- Duty of care: The person or business that hurt you had a legal duty to act safely. Drivers must follow traffic laws, and property owners must keep their premises reasonably safe.
- Breach of duty: They failed to meet that duty. Examples include texting while driving, leaving a spill on a store floor or ignoring a broken stair railing.
- Causation: Their failure caused your brain injury. We use medical records, imaging and expert opinions to connect the accident to your symptoms.
- Damages: You suffered real losses because of the injury. These include medical bills, lost income and the ways the injury has changed your life.
Fault can also be shared. Under New Jersey’s comparative negligence law, N.J.S.A. 2A:15-5.1, your award drops by your share of fault, and you recover nothing if you are found more at fault than the other side.
Costs a brain injury claim should cover, now and later
A brain injury claim should cover today’s costs and the costs you will face for years. Depending on your case, you may recover:
- Economic damages: These cover hospital stays, scans, surgery, rehabilitation, medication and lost wages. They also include future care and lost earning ability if you cannot return to your job.
- Non-economic damages: These cover pain, emotional distress, memory problems and loss of enjoyment of life. A spouse may also have a claim for the loss of companionship and support.
- Punitive damages: These are rare and require clear and convincing proof of actual malice or wanton and willful disregard under N.J.S.A. 2A:15-5.12. N.J.S.A. 2A:15-5.14 caps them at five times compensatory damages or $350,000, whichever is greater.
The table below shows how brain injury claims often compare in value. Every case is different, and these are general ranges, not promises.
| Injury category | Common examples | General value range |
|---|---|---|
| Mild TBI with a full recovery | Concussion with headaches or dizziness that clear up within weeks | Lower |
| Mild TBI with lasting symptoms | Post-concussion headaches, memory or focus problems that last for months | Moderate to higher |
| Moderate TBI | Brain bleeding or bruising, a hospital stay and months of rehab therapy | Higher |
| Severe TBI | Coma, permanent cognitive disability or a need for lifelong care | Often the highest |
If your TBI came from a car crash, different rules apply. Your own Personal Injury Protection (PIP) coverage pays your medical bills first, no matter who caused the crash.
If your policy has the Limitation on Lawsuit option, you can sue for pain and suffering only if your injury fits a category in N.J.S.A. 39:6A-8(a), such as a permanent injury. A brain injury that has not healed to function normally can qualify, and we gather the medical proof to show it.
Even drivers with a low-cost Basic Policy get extra protection here. The state’s auto insurance guide shows that Basic Policy PIP pays up to $250,000 for permanent or significant brain injury.
Hypothetical scenario: A driver stopped at a light on Route 46 is rear-ended and feels only a stiff neck at first. Days later, headaches and memory lapses lead to a concussion diagnosis, and months of records showing lasting symptoms support a claim under the permanent injury category.
We do not list brain injury figures here because every past result depends on its own facts. You can review the outcomes we have reached for other injured clients on our case results page.

Who can you hold liable?
Brain injuries happen in many settings, and more than one party may share the blame. As your New Jersey brain injury lawyer, we look at everyone who played a role:
- Negligent drivers: Drivers who speed, text or drive drunk cause many head injuries. Their auto insurance is usually the first source of payment.
- Employers of at-fault drivers: A trucking company, delivery service or other business may be responsible for a worker who caused a crash on the job. These policies often carry higher limits.
- Property owners and managers: Stores, landlords and businesses must fix hazards like wet floors, poor lighting and broken stairs. A fall on a dangerous property is a common cause of head injuries.
- Contractors on job sites: Falling tools, unsafe scaffolds and missing guardrails cause serious head injuries. A contractor other than your employer may be responsible for unsafe conditions.
- Product makers and sellers: A defective helmet, ladder or car part can cause or worsen a brain injury. New Jersey’s product liability law can hold the maker and seller responsible.
- Bars and restaurants: A business that serves alcohol to a visibly drunk person may share the blame for a crash that person causes. New Jersey’s dram shop law sets out these claims.
- Government entities: A town, county or state agency may be responsible for dangerous roads, sidewalks or public buildings. These claims require written notice within 90 days under N.J.S.A. 59:8-8.
Hypothetical scenario: A shopper slips on a puddle from a leaking cooler that staff had known about for hours. She strikes her head on the tile, so the claim names both the store and the company hired to maintain its floors.

How our Lodi traumatic brain injury law firm protects your future
A TBI touches your health, your work and your whole family. Our team works to recover what you have lost and protect what comes next:
- Lost wages and earning ability: We recover pay you missed while healing and income you may lose in the future. If you cannot go back to your old job, we show what that change will cost you.
- Medical bills: We seek payment for emergency care, neurologist visits, CT and MRI scans and therapy. We also help coordinate PIP and health insurance so bills get paid while your case moves forward.
- Long-term rehabilitation: Some survivors need cognitive, speech or physical therapy for years. We include the full cost of rehab, such as care at the Kessler Institute for Rehabilitation campus in nearby Saddle Brook.
- Proof of a hidden injury: Many mild TBIs do not show up on a CT scan. We work with doctors and neuropsychologists to document changes in memory, focus and mood.
- Emotional recovery: Depression, anxiety and mood swings are common after a brain injury. We include counseling costs and the toll on your daily life.
- Protection if the insurer blames you: Insurers may say an old condition, not the accident, caused your symptoms. We use your medical history and expert opinions to push back.
- Support for families: When a TBI leaves someone unable to manage their own affairs, a loved one often steps in. We keep the family informed and handle the legal work so they can focus on care.

Steps to take after a head injury
Once the first shock passes, these steps protect your health and your claim. If you are reading this for a loved one, you can help them follow each one:
- Get checked by a doctor right away: Some brain injury symptoms take hours or days to appear. Hackensack University Medical Center, a Level I trauma center a short drive from Lodi, treats serious head injuries.
- Attend all medical appointments and follow expert advice: Missed visits give the insurer a reason to say you are not really hurt. Follow any rest and screen-time limits your doctor sets.
- Keep a symptom journal: Write down headaches, memory lapses, sleep problems and mood changes each day. These notes help your doctors and show how the injury affects your life.
- Stay off social media: Insurers look for photos and posts that suggest you are fine. Ask family members not to post about you either.
- Do not accept the first offer: Early offers rarely reflect the cost of future care. Once you sign a release, you cannot ask for more.
- Be careful what you say to the insurer: Do not guess about details or say you feel fine. Do not give a recorded statement before we review your case.
- Get in touch with our Lodi brain injury compensation attorneys: We deal with the insurer, gather proof and track your deadline. You and your family can focus on healing.

Don't delay in starting your claim
Under N.J.S.A. 2A:14-2, you generally have 2 years from the date of the injury to file a lawsuit. If you miss it, the court will likely dismiss your case.
There are some exceptions. Under N.J.S.A. 2A:14-21, the clock usually waits until a child turns 18, and it can pause for a person whose mental disability keeps them from grasping their legal rights or starting a lawsuit.
A severe TBI may fall under that rule, but courts look closely at the facts, so do not count on extra time. Claims against a town, county or state agency move even faster, with written notice due within 90 days.
Acting quickly makes your case stronger. Crash footage, store video and witness memories are easiest to secure in the first few weeks.

Evidence to gather for your brain injury claim
Strong proof leads to stronger offers. We start gathering it right away:
- Police and incident reports: A Lodi Police Department crash report or a store’s incident report confirms when and where you were hurt. These reports may also name witnesses.
- Medical records and imaging: ER notes, CT and MRI scans and neurology visits show the injury and how severe it is. Glasgow Coma Scale scores recorded by EMTs and ER staff help, too.
- Neuropsychological testing: These tests measure memory, attention and how quickly you process information. They can reveal problems that scans miss.
- Eyewitness statements: People who saw the accident can confirm how it happened. Family members and coworkers can describe how you have changed since.
- Photo and video evidence: Dashcams, doorbell cameras and security video can capture the moment of impact. Scene photos record hazards before anyone fixes them.
- Work and income records: Pay stubs and letters from your employer show the work you missed. They also help prove future lost earnings.
- Proof of the cause: The cause of your injury shapes the whole claim. If a crash caused your TBI, our Lodi car accident lawyer team handles the PIP and liability sides together.
Collecting all of this while you recover from a brain injury is hard. Let us carry that weight so you can focus on getting better while we do the hard work.
How much are the fees?
You pay nothing upfront. We work on a contingency fee, which means we only get paid if we recover money for you.
New Jersey Court Rule 1:21-7 caps contingency fees at 33 1/3% of the first $750,000 recovered. That cap protects you, and it means our goals match yours.

Our legal process for your brain injury claim
Here is how we move your TBI case from the first call to the final payment:
- Free case review: We listen to what happened and explain your options. There is no cost and no obligation.
- Investigation: We gather reports, photos, video and witness statements. We act fast to preserve evidence before it disappears.
- Finding every insurance policy: We look at auto, PIP, uninsured motorist, business and umbrella coverage. Brain injury claims often need more than one policy to cover the full loss.
- Building the medical proof: We collect your records, scans and test results as your treatment moves forward. We wait until doctors can describe your long-term outlook before we value the claim.
- Working with experts: Neurologists, neuropsychologists, life care planners and economists may help show your future needs. Their reports put a fair number on care you will need years from now.
- Demand and negotiation: We send the insurer a detailed demand package. Then we push back against low offers.
- Filing a lawsuit if needed: If the insurer will not pay a fair amount, we file before the deadline. Many Lodi cases are heard in the Bergen County Superior Court in Hackensack.
- Discovery and trial preparation: We exchange evidence and take sworn testimony from the other side and witnesses. We prepare every case as if it will go to trial.
- Resolution: Most cases settle before trial, but we are ready to let a jury decide. Once your case ends, we walk you through the final numbers before you receive your share.

General information on brain injuries
A traumatic brain injury, or TBI, is an injury that affects how the brain works. Here is what Lodi families should know about the signs, causes and long-term effects.
Signs and symptoms of TBIs
A concussion is a mild TBI, but its effects can still be serious. The CDC notes that some symptoms appear right away, while others may not show up for hours or days.
- Headaches: A headache that gets worse and does not go away is a danger sign that needs emergency care. Report even milder headaches to your doctor.
- Thinking and memory problems: You may have trouble focusing, remembering new information or thinking clearly. Tasks that were easy may now feel slow and draining.
- Physical symptoms: Dizziness, nausea, blurry vision and balance problems are common. Many people also become sensitive to light and noise.
- Sleep changes: Some people sleep far more than usual, while others struggle to fall asleep. Both can slow your recovery.
- Emotional changes: Irritability, sadness, anxiety and mood swings can follow a brain injury. Family members often notice these changes first.
- Loss of consciousness or extreme drowsiness: Passing out, even briefly, is a warning sign. If someone cannot be woken up, call 911.
- Signs in young children: A child may cry and refuse to be comforted after a blow to the head. Refusing to nurse or eat is another danger sign.
Doctors often rate a TBI’s severity with the Glasgow Coma Scale, which scores eye, verbal and motor responses from 3 to 15. A score of 13 to 15 is mild, 9 to 12 is moderate and 3 to 8 is severe.

Common causes of traumatic brain injuries
Brain injuries are common in our state. New Jersey estimates that 12,000 to 15,000 people sustain brain injuries from traumatic events each year, and about 1,000 of those injuries are fatal.
- Falls: Falls lead to nearly half of TBI-related hospitalizations nationwide. Older adults face the highest risk of being hospitalized or dying from a TBI.
- Car, truck and motorcycle crashes: Motor vehicle crashes are another common cause of TBIs. A sudden stop can jolt the brain inside the skull, even without a direct blow to the head.
- Pedestrian and bike accidents: People on foot or on bikes have little protection when a vehicle hits them. Busy Lodi roads like Route 46 and Main Street put walkers and riders close to traffic.
- Workplace accidents: Falls from ladders and objects dropped from heights cause many on-the-job head injuries. Construction and warehouse workers face the greatest exposure.
- Assaults: Assaults are a common cause of TBIs. Poor security at a bar, apartment complex or parking lot may make the property owner partly responsible.
- Sports and recreation: Collisions and falls in youth and adult sports can cause concussions. Repeated concussions may lead to a longer recovery.

Complications of a brain injury
Many people recover well from a mild TBI, but a moderate or severe injury can bring problems that last for life. The same state data estimates that about 175,000 New Jersey residents live with disabilities caused by a TBI.
- Lasting thinking problems: Memory loss, slow processing and trouble learning new skills can remain after treatment ends. These changes can make school and work much harder.
- Motor, hearing and vision problems: Weakness, poor coordination and balance problems are common after a serious TBI. Some survivors also have lasting hearing or vision loss.
- Personality and behavior changes: A survivor may become more impulsive, angry or emotional than before. These changes can strain even the closest relationships.
- Seizures: Seizures can develop after a moderate or severe brain injury. Some people need medication to control them for years.
- Depression and anxiety: Mental health problems often follow a brain injury. Treatment can help, but it adds to the cost of recovery.
The long-term numbers are sobering. Five years after a moderate or severe TBI, 57% of people are moderately or severely disabled, and 33% rely on others for help with everyday activities.
How a TBI can impact the life of the injured
A brain injury affects more than health. Work, money and family life can all change at once.
Work is often the first loss. CDC data on that same 5-year window shows that 55% of people who had a job when they were injured no longer have one.
Hypothetical scenario: A warehouse worker in Bergen County suffers a moderate TBI after a fall from a loading dock ladder. Two years later, balance problems keep him from returning to forklift work, so the claim includes the gap between his old pay and the lower-paying job he can now do.
Families feel the change, too. Spouses may become caregivers, children may take on new roles and household budgets can shrink fast.
New Jersey offers help for survivors. The state’s Traumatic Brain Injury Fund, run by the Division of Disability Services, buys supports and services for residents of any age when insurance and other programs fall short.
Under the Fund’s eligibility rules, applicants must have liquid assets of less than $100,000 and can request up to $15,000 a year. The Brain Injury Alliance of New Jersey also runs a helpline and virtual support groups for survivors and caregivers.

Frequently Asked Questions
Can I file a claim if I hurt my head at work?
Yes, workers’ compensation pays your medical bills and part of your lost wages, but New Jersey law generally bars suing your own employer. If someone else caused the injury, like a negligent driver or another contractor on the site, we may also bring a separate claim for your full losses.
What if my loved one is too injured to make legal decisions?
A family member may need to ask a New Jersey court to appoint a guardian for an adult who cannot manage their own affairs. The guardian can then make decisions about the injury claim, and we work with the family so the case keeps moving while your loved one recovers.
Do I have to see the insurance company's doctor?
In many cases, yes, because your own PIP insurer can request an independent medical exam, and the defense can ask for one once a lawsuit is filed. We prepare you for what to expect, and your own doctors’ records help counter any report that downplays your brain injury.
How long does a brain injury case usually take?
Many brain injury cases take a year or more because symptoms can change for months, and we want doctors to know your long-term needs before we negotiate. A case may settle sooner if the facts are clear, or take longer if a lawsuit and trial become necessary.
Will my health insurance want to be repaid from my settlement?
Possibly, because some plans, including Medicare, Medicaid and certain employer plans, have a legal right to be repaid from an injury recovery. We identify these claims early, confirm the amounts are correct and work to reduce them where the law allows, so more of your settlement stays with you.
