Lodi Car Accident Lawyer

Injured in Jersey? Peter's Got Your Back!

At The Law Offices of Peter N. Davis & Associates, LLC, our Lodi car accident lawyer helps injured drivers, passengers, and families recover the money they need after a crash that wasn't their fault.

We know how fast the bills, missed paychecks, and calls from adjusters pile up while you’re still in pain.

Waiting can cost you. Evidence fades, insurers build their case from day one, and New Jersey’s two-year deadline keeps running whether you’re ready or not.

Our team takes that weight off your shoulders, from dealing with the insurance companies to building the claim that gets you paid. As a trusted Lodi personal injury lawyer, we’ve recovered over $1 billion for injured clients in over 37 years of practice.

Can you file a claim after a Lodi car crash?

You may have a claim if another driver’s carelessness caused your crash and your injuries. To build that claim, our team needs to prove four elements:

  • Duty of care: Every driver in Lodi must follow traffic laws and drive with reasonable care. This duty applies on Route 17 as much as it does on a quiet side street.
  • Breach of duty: The other driver broke that duty by speeding, texting, running a light, or driving drunk. We prove this with police reports, video, and witness accounts.
  • Causation: The driver’s mistake must have caused the crash and your injuries. Insurers often argue your pain came from something else, so we connect the dots with your medical records.
  • Damages: You suffered real losses, such as medical bills, lost income, or pain. Without losses, there is nothing to recover, even if the other driver was clearly at fault.

Being partly at fault doesn’t automatically end your case. Under New Jersey’s comparative negligence law, N.J.S.A. 2A:15-5.1, you can still recover as long as you were not more at fault than the other side, though your award drops by your share of the blame.

Hypothetical scenario: A driver merging onto Route 46 is rear-ended by a speeding SUV, and the insurer claims she merged too slowly. If a jury finds her 20% at fault, she can still recover 80% of her damages.

What a Lodi car accident claim can pay for

The damages available to you depend on your injuries and your own auto policy. These are the main types of compensation we pursue:

  • Economic damages: These cover losses with a dollar figure, such as hospital bills, physical therapy, lost wages, and car repairs. They also include future medical care and lost earning capacity if you can’t return to the same work.
  • Non-economic damages: These cover pain, emotional distress, and the loss of enjoyment of life. If your policy has the Limited Right to Sue option, you’ll generally need an injury that meets the state’s threshold to claim them.
  • Punitive damages: These are rare and reserved for conduct like drunk or extremely reckless driving. New Jersey generally caps them at five times your compensatory damages or $350,000, whichever is greater, under N.J.S.A. 2A:15-5.14.

Under the Limited Right to Sue option, the New Jersey auto insurance buyer’s guide lists six qualifying injuries: loss of a body part, significant disfigurement or scarring, a displaced fracture, loss of a fetus, a permanent injury, or death. We review your policy and medical records early to see which rules apply to you.

What is my car accident case worth?

Every case is different, so no lawyer can promise a number. The value of your claim depends on your injuries, your treatment, your lost income, and the insurance coverage available.

The table below shows, in general terms, how injury severity tends to affect a New Jersey car accident claim. These are broad categories, not promises or predictions:

Injury category Common examples General value range
Minor injuries that fully heal Sprains, strains, and bruising Lower. PIP usually covers the medical bills, and pain and suffering may be limited under the Limited Right to Sue option.
Moderate injuries Displaced fractures and injuries that need surgery Moderate to higher, depending on treatment and time off work.
Serious or permanent injuries Herniated discs with lasting limits, traumatic brain injuries, and significant scarring Higher, especially when future care and lost earning capacity are involved.
Fatal injuries Wrongful death claims brought by the family Often the highest, based on lost income and support, household services, and funeral costs.

Under New Jersey law, any award is reduced by your share of fault, and you can’t recover if you were more at fault than the other side. The insurance coverage available can also limit what is practically recoverable.

Careful preparation can push results well beyond an insurer’s early offer, as these past auto accident case results show:

  • $800,000: We secured this result for a client hurt in an auto accident. It reflects our focus on proving the full cost of an injury.
  • $700,000: We obtained this recovery in a second auto accident case. Past results don’t guarantee a similar outcome in your case.

What our Lodi car accident law firm does for you

A serious crash affects your health, your income, and your peace of mind all at once. Our Lodi car accident law firm works to recover compensation for every part of that harm:

  • Lost wages: We document the paychecks you’ve missed and the income you may lose in the future. This includes overtime, bonuses, and lost earning capacity.
  • Medical bills: We track every bill and coordinate with your PIP carrier and health insurer. This helps keep collectors off your back while the claim moves forward.
  • Property damage: We help you get your car repaired or replaced at its fair value. We also pursue rental costs and personal items damaged in the crash.
  • Emotional recovery: We make sure anxiety, sleep problems, and fear of driving are part of your claim. These harms are real, even when they don’t show up on an X-ray.
  • Future care: We work with your doctors to estimate the treatment you’ll need later. Settling too early can leave you paying for surgery out of your own pocket.
  • Liens and paperwork: We handle the forms, deadlines, and any liens on your settlement. You focus on healing while we handle the details.

Car accident myths that cost Lodi drivers money

Many people in Lodi hold off on calling a lawyer because of something they heard from a friend or an adjuster. Here are some common myths we hear, and the facts behind them:

Myth Fact
“New Jersey is a no-fault state, so I can’t sue the other driver.” No-fault PIP pays your medical bills, but you can still sue the at-fault driver for pain and suffering if you have Unlimited Right to Sue or your injury meets the threshold.
“If I was partly to blame, I get nothing.” You can still recover in New Jersey as long as you were not more at fault than the other side.
“The insurer’s first offer shows what my claim is worth.” First offers usually come before anyone knows the full cost of your injuries, and they are often far below what a claim is worth.
“Soft tissue injuries never count in New Jersey.” A soft tissue injury can qualify as permanent when objective medical proof shows it won’t heal to function normally.
“Insurers don’t have to tell me how much coverage the other driver has.” Since 2021, New Jersey insurers must disclose the policy limits when an injured person’s lawyer asks for them.
“I can’t afford a lawyer.” We work on a contingency fee, so you pay nothing unless we recover money for you.

What to do in the first days after a crash

Once you’re home and the shock has worn off, the next few days shape your claim. These are the steps we recommend:

  1. Get in touch with our Lodi accident lawyer: Insurers start working against your claim right away, so having us on your side early levels the playing field. Waiting weeks to call gives the other side time to shape the story.
  2. Get proper medical care: See a doctor even if you feel only sore, since some injuries show up days later. Gaps in treatment are one of the first things adjusters use to cut a claim.
  3. Get a copy of the police report: The report records the officer’s notes, witness names, and insurance details. You can request it through the Lodi Police Department’s records division.
  4. Notify your own insurance company: Your policy requires prompt notice to open your PIP claim for medical bills. Stick to the basic facts and don’t guess about your injuries.
  5. Stay off social media: Adjusters look for photos and posts that suggest you’re not really hurt. Even a smiling picture at a family event can be taken out of context.
  6. Don’t accept the first offer: Early offers usually come before anyone knows the full cost of your injuries. Once you sign a release, you can’t reopen the claim later.
  7. Watch what you say to insurers: Phrases like “I’m fine” or “I didn’t see them” can be used to deny or reduce your claim. Let us speak with the other driver’s insurer for you.
  8. Keep a recovery journal: Write down your pain levels, missed events, and daily struggles. These notes help us prove the impact of your injuries months later.

How auto insurers try to lower your settlement

Before founding our firm, Peter N. Davis worked in insurance defense, so we know the playbook insurers use. Handling these tactics alone is hard, especially while you’re hurt:

  • Quick lowball offers: Adjusters may offer fast cash before you know how serious your injuries are. Accepting usually means giving up any right to more money later.
  • Early recorded statements: The insurer may ask you to “just tell your side” on a recorded call. Your words can be twisted to suggest you were at fault or not badly hurt.
  • Requests for all your medical records: Some adjusters ask for years of records to blame your pain on an old injury. We limit what they see to what’s relevant.
  • Delay tactics: Slow responses can pressure you into settling when the bills get overwhelming. We keep the claim moving and hold insurers to their deadlines.
  • Social media surveillance: Insurers check your public profiles for anything that downplays your injuries. Setting accounts to private and posting less protects your claim.
  • Disputing your treatment: Insurers may call your care “unnecessary” to avoid paying for it. We work with your doctors to show why each treatment was needed.

Warning: Giving a recorded statement without legal advice could be used to limit your compensation later.

What if the at-fault driver is uninsured?

Uninsured drivers are more common than most people think. The Insurance Research Council estimated that 14.1% of New Jersey motorists were uninsured in 2023.

Your own policy is usually the first place we look. These coverages can help:

  • Uninsured motorist (UM) coverage: This pays for your injuries when the at-fault driver has no insurance or flees the scene. Every standard New Jersey policy must include a minimum amount.
  • Underinsured motorist (UIM) coverage: This steps in when the other driver’s limits are too low to cover your losses. New Jersey’s standard minimum bodily injury limits are now $35,000 per person and $70,000 per accident.
  • The Unsatisfied Claim and Judgment Fund: When no insurance is available at all, the Unsatisfied Claim and Judgment Fund (N.J.S.A. 39:6-61 et seq.) may pay limited benefits in some hit-and-run and uninsured cases. Strict notice rules apply, so speed matters.

We also look for other sources, such as a negligent employer, a vehicle owner, or a household member’s policy. New Jersey’s Insurance Fair Conduct Act also lets you sue your own insurer for an unreasonable delay or denial of a UM or UIM claim.

Hypothetical scenario: A driver is sideswiped on Main Street by a car that speeds off before anyone gets the plate number. Her own UM coverage may pay for her injuries, and her PIP coverage still pays her medical bills.

Acting quickly and speaking with a lawyer helps protect the value of your claim. Additional reading: what to do if an uninsured driver hit your car in New Jersey

New Jersey's two-year deadline for car accident lawsuits

In New Jersey, you generally have two years from the date of your crash to file a car accident injury lawsuit under N.J.S.A. 2A:14-2. Property damage claims generally have six years, and wrongful death claims have two years from the date of death.

Shorter deadlines can apply. If a town, county, or state agency played a role, such as a dangerous road defect, a notice of claim is generally due within 90 days under N.J.S.A. 59:8-8.

The sooner you call us, the more time we have to gather evidence and protect your rights. Additional reading: how long after a wreck you can file a claim in New Jersey

Evidence that proves who caused your crash

Strong evidence is what turns a claim into a fair settlement. These are the items we start collecting right away:

  • Police documentation: The crash report and any tickets issued to the other driver.
  • Medical records: ER notes, imaging, specialist reports, and therapy records that link your injuries to the crash.
  • Eyewitness statements: Accounts from other drivers, passengers, or people on the sidewalk who saw what happened.
  • Photos and video: Pictures of the scene and vehicles, plus traffic or business camera footage from nearby stores.
  • Proof of driver negligence: Phone records, toxicology reports, or vehicle data showing speeding or distraction.
  • Vehicle damage estimates: Repair bills and photos that show the force of the impact.
  • Employment records: Pay stubs and a letter from your employer confirming missed work.

Business camera footage is often recorded over within days, so early action matters. Gathering all of this while you’re in pain is exhausting, which is why we take it on and let you focus on recovery.

How our contingency fee works

You pay nothing up front to hire us. We work on a contingency fee, which means our fee comes out of the money we recover, and if we don’t win, you don’t pay.

New Jersey Court Rule 1:21-7 caps contingency fees on the first $750,000 at 33 1/3%, with lower percentages on larger recoveries. We explain the fee and how case costs work in writing before you sign anything.

How PIP covers your medical bills after a crash

New Jersey uses Personal Injury Protection (PIP) instead of the MedPay coverage found in many other states. Your own PIP pays your medical bills no matter who caused the crash, with standard policies offering coverage as low as $15,000.

  • PIP: Your auto policy pays first for most crash-related treatment. You may owe a deductible and a 20% copay on part of the bills.
  • Health insurance: If you chose health insurance as your primary PIP payer, your health plan pays first and PIP covers what’s left.
  • Delayed payment through settlement: Some providers will wait to be paid until your case resolves. We help settle any liens before you receive your share.

When bills go beyond your PIP limit, we help you find the next source of payment. Additional reading: are your medical bills covered after an accident?

Infographic: our 12-step process for handling your Lodi car accident case, from a free case review to resolution

From first call to settlement: how your case moves forward

We keep you informed at every stage, from your first call to the day you receive your settlement check:

  1. Free case review: We listen to your story, review your documents, and explain your options. There’s no cost and no obligation.
  2. Investigation: We gather the police report, photos, video, witness statements, and medical records. We also send letters asking that key evidence be preserved.
  3. Notice to the insurers: We tell every insurer that we represent you. From then on, adjusters must speak with us, not you.
  4. Coverage review: We request the at-fault driver’s policy limits, which New Jersey insurers must now disclose. We also check your own UM and UIM coverage.
  5. Treatment tracking: While you focus on getting better, we track your bills and records. We wait until your doctors have a clear picture before valuing the claim.
  6. Demand package: We send the insurer a detailed demand with your records, bills, and losses. This lays out exactly why you deserve full compensation.
  7. Negotiation: We push back on low offers with evidence. Insurers know we are willing to take cases to trial.
  8. Lawsuit, if needed: If the insurer won’t pay fairly, we file suit in the Superior Court of New Jersey, Bergen County, at the Bergen County Justice Center in Hackensack. Filing on time protects your claim.
  9. Discovery: Both sides exchange documents and answer questions under oath. We prepare you for every deposition.
  10. Arbitration or mediation: Many Bergen County auto cases go through court-required arbitration or mediation. These sessions often lead to a settlement.
  11. Trial: If your case doesn’t settle, we present it to a jury. Our goal is the best result for you, not the fastest one.
  12. Resolution: We resolve liens, pay case costs, and deliver your share of the recovery. You get a clear breakdown of every dollar.

General information on car accidents in Lodi

Lodi sits at the crossroads of busy Bergen County routes, with Route 17 and Route 46 carrying heavy commuter traffic through the borough. Bergen County’s own safety data shows why careful driving matters here.

What causes most crashes in Bergen County

Bergen County’s Local Safety Action Plan found that distracted driving played a role in 26 deaths and 337 serious injuries on county and municipal roads from 2017 to 2021. The same plan names Route 17 through Lodi as a state road location of concern. These are the causes we see most often:

  • Distracted driving: A Rowan University study found that 20 to 25 percent of drivers observed on New Jersey’s high-crash roads were distracted. Handheld phones were the leading distraction.
  • Speeding and aggressive driving: Drivers rushing to Route 17 or Route 46 often follow too closely and change lanes without signaling. Speed turns a minor collision into a serious one.
  • Failing to yield at intersections: Turning drivers on Main Street and Essex Street can misjudge gaps in traffic. These mistakes often lead to T-bone crashes.
  • Drunk or drugged driving: Impaired drivers react slowly and make dangerous choices. These cases may also support a claim for punitive damages.
  • Poor weather: Rain, snow, and ice make Bergen County roads slick for much of the year. Drivers must slow down to match the conditions.

What New Jersey crash data shows about injuries

New Jersey State Police preliminary data recorded 42 traffic deaths in Bergen County in 2024. For every fatal crash, many more people are left with injuries that change their daily lives:

  • Whiplash and soft tissue injuries: Sudden jolts strain the muscles and ligaments in the neck and back. Pain can linger for months and limit work and sleep.
  • Broken bones: Arms, legs, wrists, and ribs often break on impact. Displaced fractures may need surgery with plates or screws.
  • Back and spinal cord injuries: Herniated discs and fractured vertebrae can cause lasting pain or nerve damage. Some require surgery and long-term therapy.
  • Head and brain injuries: Concussions and traumatic brain injuries can affect memory, mood, and focus. Symptoms are easy to miss in the first few days.
  • Cuts and scarring: Broken glass and airbags can leave permanent scars. Significant scarring may meet New Jersey’s lawsuit threshold.

Many seriously injured Lodi crash victims are treated at Hackensack University Medical Center, just a few miles away. Students and staff at Felician University’s Lodi campus are among the many people who share the borough’s busy roads.

Healing times for common crash injuries

Recovery depends on your age, health, and the force of the crash. This table shows the general timelines we see in our clients’ cases, though your doctor will set your own plan:

Injury type Typical recovery time Common treatment
Whiplash A few weeks to several months Rest, physical therapy, pain management
Broken arm or leg 6 to 12 weeks, longer with surgery Casting, surgery with hardware, rehab
Concussion Days to weeks, longer if symptoms persist Rest, gradual return to activity, neurology follow-up
Herniated disc Several months or more Physical therapy, injections, possible surgery
Fractured vertebrae Several months to a year Bracing, surgery, long-term rehab

Insurers often push for a quick settlement before you finish treatment. We wait until we know the full picture, so your recovery reflects the true cost of your injuries.

Frequently Asked Questions

Passengers usually have the strongest claims because they rarely share any fault. In New Jersey, your own household auto policy typically pays your PIP benefits first. If you don’t have a car policy, the driver’s PIP may apply, and you can pursue the at-fault driver for your other losses.

Yes. If you were on the clock, you can usually file a workers’ compensation claim for medical care and lost wages. You may also bring a separate claim against the at-fault driver for pain and suffering, which workers’ comp doesn’t cover. We coordinate both claims so the benefits work together.

A police report is the officer’s opinion, often based on a few minutes at the scene. It isn’t the final word on fault. We review camera footage, vehicle damage, and witness accounts, and we can challenge errors in the report to protect your right to compensation for your injuries.

Yes. Your property damage claim usually moves separately and much faster than your injury claim. You can often get repairs or a total loss payment within weeks, through your own collision coverage or the other driver’s insurer. Settling the car claim doesn’t end your right to pursue injury compensation.

Most cases take several months to a few years, depending on your injuries and the insurer’s response. We usually wait until you finish treatment so we know the full value of your claim. Cases that settle without a lawsuit tend to resolve faster than cases that go to court.
