In most cases, New Jersey Law allows you two years from the date of the brain injury to file a personal injury claim.
However, there are exceptions to this rule. For example, if the injured person is a minor, the two-year clock generally starts on their 18th birthday. In some situations, like when symptoms emerge later or the injury isn’t immediately diagnosed, the “discovery rule” may extend the statute of limitations to a later date.
Because timing can be so impactful to your case and the exceptions are limited, it’s wise to contact a brain injury lawyer as early as possible after suffering a head or brain injury to protect your right to pursue compensation.
